What to Consider BEFORE Terminating an Employee
|
According to the 2017 Equal Employment Opportunity Commission Report, there were 82,254 workplace discrimination charges filed with the federal agency. The Commission released a list of the top 10 employment discrimination claims showing retaliation at the top with 41,097 charges which constituted 48.8% of all charges filed against employers.
This is important because our office sees many wrongful termination suits and wanted to provide your organization with some basic risk management guidelines that may mitigate future claims. Terminating an employee can be difficult and costly. In the event of an employment termination lawsuit, Employment Practice Liability Insurance (EPLI) may be available to defend your organization. EPLI can be written as a standalone policy or is combined with Directors & Officers Coverage.
Before terminating an employee, consider obtaining legal advice to determine the possible ramifications. Below is a pre-termination checklist provided by our friend, Shannon Jenkins, Esq.
If your organization hires employees, consider obtaining an employment practice liability insurance policy. Let us know if you would like us to provide a quote for EPLI or have any questions.
